At some point in a director’s daycare career she will find herself on the front lines of a child custody situation or a restraint order. One day a parent will arrive to say, “My husband and I are splitting and he can no longer visit my child in daycare or pick up my child.” At this point, alarm bells should start ringing in the director’s head.
The director has a couple of serious legal obligations to consider.. First, in the interest of the child’s personal safety, under no circumstances would a director release a child to anyone who is not authorized. In this custody case both parents have the right to have access to their child. In the restraint order case it could be someone other than a parent. What should she do?
Second, as sad as it is, the director must think about the possibility of a child abduction from the daycare facility. This can happen easily when the child is on the playground or taking a walk with the class. If it is the unauthorized parent trying to abduct, the child often will go willingly and a teacher may think nothing is amiss. If it is a stranger to the child, the teacher may ask questions but find the stranger is on the formally authorized list. What should the director do?
Upon hearing the news that parents are having child custody issues or restraint orders, the director must immediately make clear the following to bother parents:
1. The child care center is in no position to favor one parent over another. If there is a court order or a restraint order in place, a copy must be kept in the main office and a copy must be with the teacher in charge at all times.
2. If there is no court order, then as is usual procedure, all parents will have normal access to their child while at the center. This includes drop-off and pick-up privileges as well as daytime visits.
3. If there is a court order or restraint order in place and the offending person attempts to ignore the court order, a 911 emergency call will be placed to prevent problems.
4. The director must also alert a member of her board that such an issue is pending at the child care center. If the center is owned or operated by a corporation then she should immediately notify her immediate superior as well as any security guards on duty.
5. Since child care centers often have rotating staff and schedules, the director must alert all staff members of the court order and supply specific instructions regarding what to do in an emergency situation.
6. The staff should be alerted that no information regarding a child can be given to the banned person. This information generally is a request to know if the child is present at the facility that day or even if the child is enrolled any long at the facility. There are two reasons for not providing this information. First, the director must protect the privacy of the student and the parents in the event an abduction is planned either by any person. Second, the banned person may want this information to try to build a case of child neglect or abuse in a custody battle. If the child’s enrollment information is required for a court, the director will receive appropriate documentation with a formal request.
In the event the custody issue has been resolved or the restraint order lifted the director must immediately notify every person of its new status.
It is vital that the director make clear to all parties involved that there is no judgment call on the situation and that the director follows the same procedure for all parents. Every effort to continue to provide child care services without embarrassment to the family must be made. And every effort to legally protect the center must be made.

What is an Organizational Policy?
A Policy defines an outcome; it is a premeditated rule set by a business to guide organizational direction, employees and business decisions, and to regulate, direct and control actions and conduct. Policies can range from a broad philosophy to a specific rule. They are the direct connection between a company’s Vision and its daily operations and the underpinnings to a company’s culture.
What is an Organizational Procedure?
A procedure is a means to an end. Procedures are step by step instructions, prescribing an exact sequence of action. A procedure explains how to and who (which position) will implement the policy. Procedures are specific, factual and succinct. They may include timelines, specific forms to be used and template forms. Procedures assist in eliminating common misunderstandings which can result in costly mistakes.

Policies and Procedures (P&Ps) are essential when a company requires consistency in its daily operations. They provide clarity and direction re: accountability. P&Ps assist companies in meeting legal requirements set out by the Employment Standards Act, the Human Rights Code, the Occupational Health and Safety Act and numerous other compliance requirements.
A properly written policy and/or procedure allows employees to understand their roles and level of responsibility and conduct their job by making decisions within predefined boundaries. By implementing P&Ps, management can provide guidance to employees without needing to micromanage, freeing managers to focus on strategic thought.
P&Ps allow the workforce to not only understand the accountabilities and responsibilities of their own position, but also that of their co-workers, which can foster a cooperative work environment.
